IRAV or IPC? What applies today
The rent is only updated if the contract says so, on each anniversary and with the index it names. Since 8 October 2026, under Royal Decree-law 29/2026, the increase can never exceed the IRAV, the index the INE compiles for housing rents, and that also applies to contracts signed before 2023. A contract that provides for an update without naming an index is updated with the IRAV.
On top of that, for anniversaries up to 31 December 2027 there is an extraordinary limit: without a new agreement with the tenant the increase cannot exceed 2%, and if the home is in a stressed area with the rent above the reference-price index, it cannot go up at all.
If Royal Decree-law 29/2026 is not validated
Until 30 September 2026 this rule applied, and it would return if the Congress repeals it: the cap is the IRAV for contracts signed from 26 May 2023 (Ley 12/2023), the IPC for those signed between 6 March 2019 and that date, and older ones follow what they say; a pact without an index is updated with the IGC, which counts as 0% when negative and 2% at most. Royal Decree-law 26/2026, with the same content, was repealed and only applied on 1 October 2026.

Must the rent be updated every year?
No. It is only updated if the contract says so expressly, on each anniversary of the contract. If the contract says nothing, the rent stays the same.
IRAV or IPC: which applies to my contract?
First, the index your contract names. But the increase can never exceed the legal cap: since 8 October 2026, under Royal Decree-law 29/2026, the cap is the IRAV for every housing contract, older ones too. If the contract provides for an update without naming an index, the IRAV applies.
What is the 2% cap until 2027?
Royal Decree-law 29/2026 limits the updates of anniversaries between 8 October 2026 and 31 December 2027: if the rent is above the reference-price index of a stressed area, it cannot go up; otherwise, without a new agreement with the tenant, the increase cannot exceed 2%.
What if the Congress does not validate Royal Decree-law 29/2026?
It has been in force since 8 October 2026, but the Congress still has to validate it; the previous one with the same content, Royal Decree-law 26/2026, was repealed. If it is repealed, the previous rule returns for later updates: the cap is the IRAV for contracts signed from 26 May 2023, the IPC for those signed between 6 March 2019 and that date, and a pact without an index is updated with the IGC. The calculator applies the rule in force on the date you enter, and we will update it as soon as the vote happens.
Which month of the IPC or IRAV do I use?
The last one published on the update date. The INE publishes each month's figure around the middle of the next month, so an update in early November uses September's and one in late November uses October's. The IPC flash estimate does not count: wait for the final figure.
How do I tell the tenant about the increase?
In writing, stating the percentage applied. The new rent can be charged from the month after the notice, and a note on the previous month's receipt is valid. If the tenant asks, you must give them the INE certificate with the index.
Does it apply to seasonal or holiday lets?
No. It is the yearly update of housing contracts under the Urban Leases Act. Holiday lets are not updated this way, and seasonal lets have their own rules since Royal Decree-law 29/2026.
Do you let homes? In Keyio for long-term lets you keep each contract's update clause and, on each anniversary, it proposes the maximum increase with the latest INE index. You confirm it and it applies to the following months' payments.
